How long does a Social Security disability decision take?
Initial decisions often take several months, and appeals can add many more. SSA publishes current processing times on SSA.gov. Expedited processing is available to some veterans.
Do I need a representative?
No, you can apply on your own. A representative helps gather evidence, meet deadlines, prepare you for a hearing, and present your case.
What does it cost?
Nothing up front. Our fee is 25% of past-due benefits, capped at SSA's maximum (currently $9,200), and only if you win. SSA must approve the fee. Some out-of-pocket costs, like requesting records, may be addressed in your fee agreement.
Can I get SSDI and VA disability at the same time?
Yes. VA compensation doesn't reduce SSDI. VA payments do count as income for SSI.
What is SGA?
Substantial gainful activity, the earnings level SSA uses to decide whether you're working too much to be considered disabled: $1,690/month in 2026 ($2,830 if blind, for SSDI).
What if I'm over 50?
SSA's rules (the 'grid rules') consider age, education, and work experience at step 5. Being 50 or older can make it easier to qualify if you're limited to certain types of work.
Will SSA review my case later?
Yes. SSA does periodic continuing disability reviews. How often depends on whether improvement is expected.
Can children get disability benefits?
Children may qualify for SSI if they meet the childhood disability standard and the household meets the financial rules. Adult children disabled before age 22 may qualify on a parent's record.
